OUR

SERVICES

Whether it be litigation, criminal matters, or business transactions, the attorneys at the Cook Phelan are zealous advocates for their clients, as well as trained mediators.

Areas of Practice:

FAMILY LAW & Divorce

Dissolving a marriage, or fighting for custody can be extremely difficult and emotionally draining. The outdated divorce model seeks to pit parties against each other, resulting in a contentious, drawn out process. We are vehemently opposed to this model.

Instead, we try to reach outcomes for clients that avoid exorbitant legal fees and animosity towards their partner, and achieve client based goals. If you find yourself saying “I want a divorce, but still want to have a good co-parenting relationship with my ex,” then you have come to right firm.

While we encourage and facilitate clients to settle issues out of court, we know some situations are meant to be heard in front of a judge. We are experienced trial attorneys in divorce, custody disputes, parenting plan amendments, order of protections, emergency orders, child support, alimony, adoptions, step-parent adoptions, and termination of parental rights.

Kids or no kids, substantial marital assets or none, heavy debt or not, we aim to make your family law matter a little less stressful than it could be.

REAL ESTATE

As we all know, the real estate market in Gallatin Valley is booming. With the COVID-19 crisis, we anticipate the valley to continue to grow at an unprecedented rate. Buying or selling a house without a realtor? We’re happy to prepare and file all necessary paperwork for minimal fee. Looking at investing in a Big Sky rental with a few friends? Needing review of daunting commercial loan documents? Give us a call.

MEDIATION

Mediation is a process in which parties use a neutral third party to settle their disputes. When divorcing in Gallatin County, all parties are required to attend mediation.

Besides Bridger Bowl on a powder day, there is nowhere else CJ Cook would rather be than in the mediator’s chair. It is his professional passion and calling. With extensive training, he is trained in facilitating a productive dialogue between parties, while effectuating negotiated settlements.

Mediation is a great avenue to keep costs low, where parties can split the cost of one mediator, versus paying for his or her own attorneys.

CRIMINAL LAW

Being arrested and facing a criminal charge can be one of the scariest moments in a person’s life, and a good attorney is necessary to ensure peace of mind and a favorable result.

Whether it be a DUI, DWI, traffic violations, drug related crimes, or other violent offenses, we have you covered.

PERSONAL INJURY

A personal injury occurs when someone suffers harm because of the carelessness, or negligence, of another person. The negligent party might be a driver who is impaired or distracted behind the wheel, a property owner who fails to maintain the condition of their property, or a manufacturer who offers dangerous, faulty products to a consumer.

In a personal injury claim, the victim of negligence takes legal action to recover the costs of the injuries they have suffered. These claims are usually filed with the assistance of an attorney. The details of a claim – how much it is worth, or how long it might take – differ from one case to another. Contact us today to find out more.

FLAT FEE & Limited Scope SERVICES

Retaining an attorney can be financially terrifying. We know that not everyone can afford a full time attorney. So we try to work within people’s budget.

We offer an “a la carte” of legal services, helping in limited scope representation. This means we can consult with you on an as needed basis, or review necessary documents.

We also help prep documents on a flat fee basis. Need a deed or agreed upon divorce decree prepared? We do that, and can work within your budget.
